Permanent Residence Applications for Study & Work Permit Holders

  • People in Canada on Study Permits (Students) and Work Permit (Temporary Workers) are encouraged to apply for immigration. The Immigration Department considers them to have excellent potential as immigrants since they have Canadian education and work experience.
  • The individuals cannot apply for Permanent Residence Status from within Canada but they are allowed to file their immigration applications at the Canadian Visa Office in Buffalo (Canadian Experience Class) or at the new Centralized Intake Office (CIO) in Sydney, Nova Scotia. Normally there is no personal interview and the processing times are fast. The applicant does not have to apply in their country of Citizenship or normal residence where processing times can often be quite slow.
  • In addition, some provinces have Provincial Nomination Program's (PNP's) for Students and Temporary Workers. Buffalo will process those cases on a fast track basis.
  • Qualifying for Immigration

    Students and Temporary Workers must qualify for immigration in the same way as all workers (see VML pamphlet Immigration for Skilled Workers - Permanent Residence in Canada). This requires reaching the pass mark (currently 67). In addition, the applicant must have one year of skilled work experience.
  • The immigration office will not process an application of a person who does not have one year of skilled experience, no matter how high their point score.
  • This creates three groups:

    1. People who don't have one year of skilled work experience - Workers who have this problem will cure it by working here on their Work Permit. Students who have this problem will cure it by getting a Work Permit after graduation (Post - Graduate Work Permit).
    2. People who do have one year of experience but don't have 67 points - People will cure this by getting more points (Arranged Employment; Language; etc.)
    3. People who have one year of experience and who do have 67 points - People in this group can file their application for Permanent Resident Status if they are POL or AEO.
  • People in group 1 and 2 should know that they can file now. The problem that they have will cure itself with time. They do not have to wait to file until after the problem is solved.
  • For example, a Student with two years of work experience overseas, fluent English, with a high school diploma and in the third year of BA program in Canada will score 10 (age) + 17 (work) + 16 (English) + 5 (High school) + 5 (two years of study here ) = 53, but will have 68 as soon as they get their BA.
  • People with no work experience who are about to graduate from their first BA degree will score 10 (age), 5 (high school), 0 (work), 16 (English), 5 (2 years of school here) = 36 but will be able to get a Work Permit after graduating and on the assessment date will score 10 (age) 20 (bachelor degree), 16 (English), 15 (work), 5 (2 years study here), 5 (one year work here) = 71.
  • People in group 2 can get a 10-15 bonus immediately if they obtain an offer of Permanent Arranged Employment (see VML pamphlet on Permanent Arranged Human Resources and Skills Development Canada Employment).
